Terms and Conditions

These terms and conditions cover your rights and obligations in relations to all offers, quotations and sales of computers hardware, software, documentation, peripherals, manipulables and related services by TAG Learning Ltd (TAG) to any purchaser or potential purchaser (Purchaser).

Your Right to Cancel

Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any item within seven working days of delivery. This applies to all TAG Learning Ltd. ("TAG") products. However, we regret that we cannot accept cancellations of contracts for the purchase of video, DVD, audio, computer peripheral and software products where the item has been unsealed.

Please note that if your order has been dispatched, then we will be unable to cancel it. If you do wish to cancel an order after it has been dispatched, all costs of returning the goods to TAG will be at your expense.

Please state clearly your order number, the date of purchase, your name and contact details, the item you wish to cancel and the reason for the 'cancellation of contract.'

If you wish to amend an order after it has been confirmed, please contact TAG Sales Support by email, phone or fax (details above) indicating your name, order number and contact details as well as information on what you would like to amend. This will need to be received within the same working day of placing your order, or TAG will not be able to amend the order.

Wrong Delivery Address Input

If you provide us with a wrong delivery address and your goods are signed for by another party, then TAG Learning Ltd cannot be held responsible for any loss you incur as a result.

Returns Policy

At TAG, we want you to be delighted every time you shop with us. Occasionally though, we know you may want to return items, so below is our returns policy.

Any product can be returned for whatever reason for a refund of the cost of the product as long as the product is returned in its original condition. Please ensure that that software, computer peripheral, DVD, video and audio products have unopened packaging and/or seals, unless the item is faulty. To receive the refund, the product must be received by our Returns Department in its original condition and have been sent to us within 30 days of your receipt of the goods at the address shown below:

You will be fully refunded, including return of the delivery costs for the UK and proof of posting for Europe, for any product, that is damaged, faulty or incorrectly shipped or any circumstance that is in our error.

To return a defective or incorrectly shipped item, please contact TAG's Sales Support team by email: sales@taglearning.com, telephone on 01474 357 350 or facsimile on 01474 537 887. They will provide you with a "Returns Authorisation Number." When returning your goods, please enclose a note giving the reason for the return and quote your unique Returns Authorisation Number, wrap the package securely and send the package to the above address by guaranteed postal delivery.

In the case of a defective product, please provide a full description of the fault, quote your unique Returns Authorisation number and return the defective item in its original box (if any), with all warranty cards, licences, software, manuals and accessories to the above address by guaranteed postal delivery.

For your protection, we recommend that you use a recorded-delivery service where a signature is required upon delivery. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is faulty. If we do not receive the item(s) back from you, we may arrange for collection of the item(s) from your residence at your cost. If non-faulty returned goods are not shipped back to TAG using a recorded delivery service and do not arrive at TAG, then TAG cannot guarantee that it will be able to provide you with a credit for those items.

Delivery Timescale

When an item is in stock, TAG Learning Ltd. will normally dispatch goods within 3 working days. For product that is out of stock, please allow 28 days of ordering. If for any reason goods are delayed beyond our control for longer than 28 days, all customers will be notified in writing.

  1. Orders and Delivery
    1. Any agreement between TAG and Purchaser shall be binding only if and to the extent that an individual order is expressly accepted by TAG in writing. TAG will have full discretion in accepting and rejecting any order.
    2. Prices and availability of Products are subject to change without notice.
    3. The Purchaser will pay to TAG the price of the Products shown on the order, plus post and packaging, plus VAT, either at the time the order is placed in the case of individual purchasers, or within 28 days of delivery or the date of our invoice, in the case of institutional purchasers (e.g. schools, universities).
    4. In the event of late payment by the purchaser we reserve the right to suspend further deliveries and charge interest at a rate of 4% over the Barclays Bank Base Rate in force from time to time and repossess Products that have not been paid for.
    5. Products will be deemed accepted by you on receipt. The purchaser will bear the risk of loss or damage to the Product from the time of delivery.
    6. TAG may make partial delivery and invoice for goods separately except where expressly agreed as 'one delivery' at the time of the order.
  2. Licences
    1. On acceptance of an order by TAG you are granted a non-exclusive, non-transferable licence to use each copy of the software supplied, together with documentation, under the order on a single computer at any one time or as stated on the licence agreement.
    2. The purchaser must observe all the copyright requirements of individual Products, including documentation, and ensure that where copying is permitted that all such copies carry the proprietary notices.
    3. Where Products carry their own licence terms additional to those stated herein, these will prevail over the conditions stated herein. Where these are not acceptable to the Purchaser and the Purchaser returns the Product unused and unopened, with licence agreement or seal 'intact', TAG will, for its own manufactured Product make a refund and for other Products attempt to negotiate with the manufacturer/distributor for a return and refund.
  3. Warranty
    1. TAG warrants the Product manufactured by TAG against defects in material and workmanship for a period of 12 months from the date of delivery.
    2. All software is licensed on an "AS IS" basis. TAG makes no warranties, either expressed or implied, with respect to any software, its quality, its performance, merchantable or fitness for any particular purpose. The entire risk is with the purchaser.
    3. TAG does not warrant any used Products, or Products not manufactured by TAG.
    4. TAG warrants that any service will be provided with due diligence and professional standard of care. Provided that TAG is notified within 28 days of the completion of a service, TAG will, as its sole liability, repeat the services or remedy the breach.
  4. Intellectual Property Rights
    1. TAG and our licensor's retains all intellectual property rights in the Products.
  5. Exports and Resale
    1. The Purchaser should consider all Products supplied by TAG are prohibited for export or resale outside the UK.
    2. If the Purchaser wishes to export from the UK or resell outside the UK any Products supplied by TAG, the purchaser will be responsible for obtaining consents and licences.
  6. Limitation of Liability
    1. In case TAG, by its negligence cause accidental death, bodily injury, damage to or loss of material property its liability will not exceed £1,000,000 in respect of any one event.
    2. In the case of Products, TAG liability will not exceed the price of the Products as purchased.
    3. These liabilities will not apply; where loss results from defects which TAG has physically remedied within a reasonable time; indirect or consequential loss of business profits, revenue or anticipated savings; loss which could have been avoided by following TAG reasonable advice and instruction.
  7. Force Majeure and Governing Law
    1. No liability can accrue to any cause beyond its reasonable control.
    2. The order will be governed and construed in all respects in accordance with English Law.
